Kalshi faces dual regulatory squeeze in Washington and New York

The Commodity Futures Trading Commission (CFTC) issued an emergency directive requiring Kalshi to continue operating under federal standards, effectively inserting itself into a high-stakes legal battle between the exchange and New York Attorney General Letitia James. The state is currently seeking over $36 billion in damages, alleging that the platform facilitates unlicensed gambling and violates local gaming regulations. The CFTC, however, maintains that its status as a federally registered exchange provides exclusive oversight that supersedes individual state enforcement actions.

Simultaneously, King County Superior Court Judge John McHale has finalized a preliminary injunction in Washington, mandating that Kalshi restrict access to contracts involving sports, elections, politics, and technology. The exchange must implement an initial IP-based geofencing system by Aug. 19, followed by a more robust multi-source verification protocol by Sept. 2. Failure to meet the latter deadline could trigger daily penalties of $120,000. While these categories are now off-limits to Washington residents, the court permitted the continued trading of financial, commodity, and climate-linked event contracts. This conflict highlights a widening rift between federal regulators and state officials over the jurisdictional boundaries of prediction markets, with courts across the country delivering inconsistent rulings on whether federal preemption protects these platforms from local gambling laws.
